Writings Online Service Terms and Conditions

SCOPE OF APPLICATION
1.1. Juan Alcantud Ramos with DNI 47076659Y on behalf of Estualia.es (hereinafter “teacher”) offers corrections for the preparation of official exams through Google Meet or Zoom.
1.2. These Conditions apply to all persons (hereinafter “User”) who make the payment of the correction through any of the means offered in the registration form. The user will not be able to access the correction of the writing until the payment has been verified by the teacher.
OBJECT OF THE CONTRACT, DESCRIPTION OF SERVICES
2.1. Users will be entitled to receive a video with the correction of the submitted writing.
2.2. The teacher will address all the areas that he/she considers necessary for the correct understanding of the correction by the user.
ACCESS, CONSENT OF LEGAL REPRESENTATIVE
3.1. The use of the services requires the acceptance of the validity of these Conditions.
3.2. The teacher will provide the correction of the writing at the e-mail address indicated by the user. In this context, the user is obliged to provide an e-mail address to which the documents can be sent. If this e-mail address changes, the user must notify us immediately, indicating the new e-mail address.
CONTRACT FOR CORRECTION OF WRITINGS
4.1. Contracts are concluded between the user and the teacher in accordance with the relevant provisions of these terms of use.
4.2. The payment of the correction must be made by any of the means provided in the registration form, being this of 8€. The corresponding amount will be paid in advance. Once the teacher has proof of payment, the user will be sent the correction of the writing within a period of no more than five working days.
4.3. The teacher reserves the right to change correction prices at any time. Such changes only apply to writings to be corrected after such change, with prior knowledge by the user of the new rate.
RIGHTS AND OBLIGATIONS OF USERS
5.1. The user must provide the teacher with a writing to be corrected in .docx format.
5.2. The user can cancel the correction of the same, as long as it is communicated in advance and the correction of the same has not already taken place, without incurring costs. In case of cancellation or postponement not in accordance with the above provisions, the teacher reserves the right to deduct the cost of the correction paid by the user.
5.3. The data sent by the teacher is confidential. The user undertakes to keep them secret. The user is responsible for all activity resulting from non-compliance with this condition.
TEACHER INFORMATION
6.1. The teacher acts in accordance with the law by being part of the self-employed regime and accounting for the income and costs of this activity. Consent, Terms and Conditions of Writings Online Service.
WARRANTY, CANCELLATION OF THE CONTRACT
7.1. In the relationship between the user and the teacher, the regulatory guarantees apply.
7.2. If the teacher has not fulfilled the contract or has done so in a deficient manner (e.g., no-show, late arrival, inadequate knowledge, inappropriate treatment of the user, etc.), the user may cancel the contract at any time. The user and the teacher agree to a review of all the
communications through all media in which they have taken place, as well as a review of Zoom or Google Meet sessions, if any, so that an independent body can make a judgment. If fault on the part of the teacher is proven, the teacher will be reimbursed for the correction or for the payment of the correction fee.

RESPONSIBILITY
8.1. The teacher is only liable, irrespective of the legal basis, if he/she is grossly negligent or intentionally negligent in causing damage. The teacher’s liability for slight negligence is excluded, except in the case of personal injury.
DURATION OF CONTRACT / TERMINATION
9.1 The contractual relationship between the teacher and the user begins with the submission of the writing by the user and ends when the correction of the writing has been received.
9.2 The teacher reserves the right not to accept writings when the teaching load is excessive and does not allow a good performance of the service.
PROTECTION OF PERSONAL DATA
10.1. Your personal data will be used for our relationship with you in order to provide you with our services. Such data is necessary for us to be able to interact with you, which allows us to use your information within the law. Likewise, those entities that need to have access to your information in order for us to provide you with our services may have access to your information. We will retain your information for the duration of our relationship and as long as we are required to do so by applicable law. In any case
